Carlyle and Extell, the developers of The Rushmore, were sued in 2010 and had to refund a total of $16 million for missing a closing deadline, which according to the developer was just a typo. This refund stands today as the largest refund in New York City history.

On August 20, another suit was filed accusing the developer for “breach of contract, fraud and intentionally failing to disclose information”. The plaintiff, Crist Bevilacqua, had an apartment under contract at the Rushmore and said in a statement, "Had the defendants been honest and given full disclosure to me as they were obligated to do, I would have never entered into this contract."
